12. Diritto di recesso ed esclusione del recesso
L’Acquirente che riveste la qualità di Consumatore ha diritto di recedere dal contratto di acquisto del prodotto senza dover fornire alcuna motivazione e senza dover sostenere ulteriori costi eccetto quelli previsti per la spedizione, entro il termine di 14 (quattordici) giorni di calendario. Il periodo di recesso termina dopo quattrodici giorni a decorrere:
a) nel caso di contratti di vendita, dal giorno in cui il consumatore o un terzo, diverso dal vettore e designato dal consumatore, acquisisce il possesso fisico dei beni o:
Per esercitare il diritto di recesso, l’Acquirente deve informare il Venditore, prima della scadenza del “Periodo di Recesso” della sua decisione di recedere a mezzo pec a ibilanciaisrl@pec.it. L’Acquirente che intende esercitare il proprio diritto di recesso deve altresì provvedere a restituire il prodotto al Venditore, utilizzando un vettore a propria scelta e a proprie spese, senza indebito ritardo e in ogni caso entro il termine di 14 (quattordici) giorni di calendario dalla data in cui ha comunicato al Venditore la sua decisione di recedere. Il termine è rispettato, se l’Acquirente rispedisce il prodotto prima della scadenza del periodo di 14 (quattordici) giorni. Il prodotto, opportunamente imballato, deve essere spedito al seguente indirizzo: I BILANCIAI S.r.l. Via dell’industria, 35 – 76121 Barletta. I costi diretti della restituzione del/i prodotto/i al Venditore sono a carico dell’Acquirente. Se l’Acquirente recede dal contratto, il Venditore procede al rimborso dell’importo pagato dall’Acquirente per il prodotto, escluse le spese di consegna utilizzando lo stesso mezzo di pagamento utilizzato per la transazione iniziale o con altro mezzo concordato, , non oltre 14 (quattordici) giorni di calendario dal giorno in cui il Venditore è stato informato della decisione dell’Acquirente di recedere dal contratto, utilizzando lo stesso mezzo di pagamento usato dall’ Acquirente per la transazione iniziale. Il Venditore trattiene il rimborso finché non abbia ricevuto i beni.
