Right of Withdrawal for the Consumer
(A consumer is a natural person who enters into a transaction for purposes which are outside their trade, business, craft, or profession.)
Right of Withdrawal
You have the right to withdraw from the contract within 14 days without providing any reason.
The withdrawal period is 2 weeks from the day:
after the date on which you, or a third party designated by you, other than the carrier, physically take possession of the goods or, in the case of a single order for multiple items delivered together, the day on which you or a third party designated by you takes possession of the last item;
after the date on which you, or a third party designated by you, other than the carrier, physically take possession of the last part shipment or the last item, or if you ordered an item delivered in multiple shipments or items;
To exercise your right of withdrawal, you must inform us (Goebel GmbH, Mühlenstr. 2-4, 40699 Erkrath, phone number: +49 (0) 211 24 50 00 0, email: sh@goebel-group.com) of your decision to withdraw from this contract by making an unequivocal statement (e.g., a letter sent by post or an email). You can use the attached model withdrawal form for this purpose, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient if the notification regarding the exercise of the right of withdrawal is sent before the expiration of the withdrawal period.
Consequences of Withdrawal
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for additional costs resulting from a delivery method other than the standard delivery offered by us) without undue delay and no later than 14 days from the day we receive the notification of your withdrawal from this contract. For the refund, we will use the same payment method you used for the original transaction, unless expressly agreed otherwise with you; in no case will we charge you any fees for the refund.
We may withhold the refund until we have received the goods back or you have provided proof that you have returned the goods, depending on which occurs earlier.
You must return the goods to us or to Goebel GmbH, Ludenberger Str. 42, 40699 Erkrath, without undue delay and in any case no later than 14 days from the day you informed us of your withdrawal from this contract. The deadline is met if you return the goods before the 14-day period expires.
You will bear the direct cost of returning the goods.
Your liability is limited to the depreciation of the goods resulting from handling them in a way other than what is necessary to establish the nature, characteristics, and proper functioning of the goods.
Exclusion or Expiration Reasons
The right of withdrawal does not apply to contracts:
for the delivery of goods that are not pre-manufactured and for which the consumer's choice or selection is decisive for their production, or which are clearly tailored to the consumer's specific needs;
for the delivery of goods that are prone to rapid deterioration or whose expiry date would soon be exceeded;
for the delivery of alcoholic beverages whose price was agreed upon at the conclusion of the contract, but which can be delivered only 30 days after the conclusion of the contract and whose current value depends on market fluctuations over which the entrepreneur has no control;
for the delivery of newspapers, periodicals, or magazines, except for subscription contracts.
The right of withdrawal expires prematurely for contracts:
for the delivery of sealed goods that cannot be returned for reasons of health protection or hygiene if the seal has been broken after delivery;
for the delivery of goods that have been inseparably mixed with other goods after delivery due to their nature;
for the delivery of audio or video recordings or computer software in a sealed package if the seal has been broken after delivery.
